ICI Insurance ("ICI," "we," "us," or "our") is an independent insurance agency headquartered in El Dorado, Kansas, with offices in Wichita, Derby, Emporia, Arkansas City, and Garden City. Protecting the privacy of the clients we serve is central to how we do business.

This Privacy Policy explains what information we collect, how we use it, when we share it, and the choices you have. It applies to ici.insurance and its subdomains, to our online forms and client portals, to our email and text message communications, and to information we collect in the course of providing insurance and risk management services.

By using our website or communicating with us, you acknowledge the practices described in this Policy.

1. Our Key Commitments

  • We do not sell your personal information. We have not sold personal information in the preceding 12 months, and we do not share it with third parties for their own marketing purposes.
  • Mobile information and text messaging consent are never shared. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the sharing categories described in this Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
  • You can opt out of any communication at any time. Reply STOP to any text message, use the unsubscribe link in any email, or contact us directly.
  • We share information with insurance carriers only to do the job you hired us to do — quoting, binding, servicing, and adjusting your coverage.

2. Information We Collect

Information you provide to us

We collect information you give us directly when you request a proposal or quote, complete an insurance application, submit a claim, make a payment, enroll in benefits, create a client portal login, subscribe to our newsletter, apply for employment, or contact us by phone, email, text, or in person. Depending on the service, this may include:

  • Identifiers — name, mailing and physical address, email address, telephone and mobile numbers, date of birth, Social Security number, driver's license number
  • Insurance and policy information — coverage history, policy and claim numbers, loss history, prior carriers, vehicle and property details, business operations and payroll data, safety and loss control records
  • Financial information — bank account or payment card information used to pay premiums, credit-based insurance score information, financial statements for business accounts
  • Employment and benefits information — job title, wages, census data, dependent information, and eligibility details for group benefits plans
  • Health information — for employee benefits, life, disability, and certain claims, we may receive health or medical information (see Section 8)
  • Communications — the content of emails, text messages, web form submissions, and voicemail or recorded calls where recording is disclosed

Information collected automatically

When you visit our website, we and our analytics providers may automatically collect your IP address, device and browser type, operating system, referring URLs, pages viewed, access times, and general geographic location. We use this to operate and secure the site, understand which content is useful, and improve performance. See Section 7 for cookie details.

Information from other sources

To quote and service insurance accurately, we may obtain information about you from insurance carriers and underwriters, insurance-support organizations and consumer reporting agencies (including motor vehicle records, loss history reports, and credit-based insurance scores where permitted by law), third-party administrators, claims adjusters, medical providers with your authorization, and publicly available sources.

3. How We Use Your Information

We use the information we collect to:

  • Prepare quotes and proposals and submit applications to insurance carriers on your behalf
  • Place, bind, service, renew, and modify your coverage
  • Report, submit, and support claims
  • Process premium payments and manage billing
  • Communicate with you about your policies, renewals, claims, billing, and service requests — by phone, mail, email, and text message
  • Provide risk management, loss control, and 360 Safety Program services
  • Respond to your questions and requests
  • Administer employee benefits programs and enrollment
  • Send newsletters, agency updates, and information about products or services that may benefit you, where you have not opted out
  • Operate, secure, and improve our website and systems
  • Detect and prevent fraud, and protect our clients, employees, and business
  • Comply with insurance regulations, licensing requirements, and other legal obligations

We do not use automated decision-making or profiling to make underwriting decisions; carriers, not ICI, make coverage and pricing decisions.

4. Text Messaging (SMS/MMS)

Consent

We send text messages only to individuals who have opted in to receive them. You may opt in by providing your mobile number on one of our web forms or written documents where text messaging consent is disclosed, by texting us first, or by giving verbal or written consent to an ICI team member. Consent to receive text messages is not a condition of purchasing any insurance product or service.

What we send

Our text messages are conversational and account-related, including:

  • Policy, coverage, and renewal updates
  • Claims status updates and information requests
  • Billing and payment reminders
  • Replies to questions you send us

We do not send marketing or promotional text messages.

Message frequency, rates, and support

Message frequency varies based on your account activity and your conversations with us. Message and data rates may apply — check with your mobile carrier. Carriers are not liable for delayed or undelivered messages.

How to opt out or get help

Reply STOP to any text message from us at any time and we will stop sending text messages to that number. You will receive one confirmation message, after which no further texts will be sent. You may also ask any ICI team member to remove your number. Opting out of text messages does not affect your policies, and we will continue to reach you by phone, mail, or email as needed.

Mobile information is never shared

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories described in Section 5 exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We share mobile numbers only with the messaging platform providers and telecommunications carriers strictly necessary to deliver the messages you have asked to receive, and those providers may not use the information for any other purpose.

5. How We Share Information

We do not sell, rent, or lease your personal information, and we do not share it with third parties for their own marketing purposes. We share information only as described below:

  • Insurance carriers, underwriters, and program managers — to obtain quotes, bind and service coverage, and process claims. We work with more than 50 carriers, and the information we submit is the information required to underwrite and service your account.
  • Claims adjusters, third-party administrators, and premium finance companies — as necessary to administer your coverage and claims.
  • Service providers — agency management systems, payment processors, email and text messaging platforms, IT and cybersecurity vendors, and professional advisors. These vendors are contractually limited to using your information solely to provide services to ICI and are required to keep it confidential and secure.
  • At your direction — to lienholders, mortgagees, additional insureds, certificate holders, your accountant or attorney, or anyone else you ask us to share with.
  • Legal and regulatory — where required by law, subpoena, or regulatory examination, or where we believe in good faith that disclosure is necessary to comply with legal process, protect our rights or property, prevent fraud, or protect the personal safety of any person.
  • Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Policy's protections.

As stated above, text messaging opt-in data and consent are excluded from all of these categories and are not shared with any third party for marketing or promotional purposes.

6. Gramm-Leach-Bliley Act (GLBA) Notice

As an insurance agency, ICI is a financial institution under the federal Gramm-Leach-Bliley Act and is subject to its privacy and safeguards requirements as well as Kansas insurance privacy regulations.

We collect nonpublic personal information about you from the sources described in Section 2. We disclose nonpublic personal information only as permitted by law — including to insurance carriers and service providers as necessary to place and service your coverage, to process transactions you request, and to comply with legal and regulatory obligations. We do not disclose nonpublic personal information about current or former clients to nonaffiliated third parties for those parties' own marketing purposes.

We maintain a written information security program with administrative, technical, and physical safeguards designed to protect nonpublic personal information, and we restrict access to employees who need it to serve you.

7. Cookies, Analytics, and Tracking

Our website uses cookies and similar technologies:

  • Strictly necessary cookies that make the site function and keep it secure
  • Analytics cookies that help us understand how visitors use the site (for example, Google Analytics)
  • Functional cookies that remember preferences

You can control cookies through your browser settings, including deleting existing cookies and blocking new ones. Blocking cookies may affect how parts of the site work.

We honor Global Privacy Control (GPC) signals where technically feasible. Because there is no common industry standard for "Do Not Track" browser signals, we do not currently respond to them.

We do not use cookies to build advertising profiles or to sell information about you.

8. Health Information

If we assist you with employee benefits, life, disability, long-term care, or certain claims, we may receive health or medical information. Where that information is protected health information under HIPAA, we handle it in accordance with HIPAA and applicable business associate obligations, and we use and disclose it only as permitted by law or authorized by you. Health information is never used for marketing.

9. Data Security

We maintain administrative, technical, and physical safeguards designed to protect your information against unauthorized access, use, alteration, and disclosure. These include access controls, encryption in transit for sensitive data, network security monitoring, vendor due diligence, and employee training.

No method of transmission or storage is completely secure. Please do not send Social Security numbers, account numbers, or other sensitive information by unencrypted email or text. Contact us and we will provide a secure method.

10. How Long We Keep Information

We retain your information for as long as you are a client and afterward for as long as necessary to service historical policies and claims, respond to coverage questions, and meet our legal, regulatory, insurance licensing, tax, and errors-and-omissions record retention obligations. Retention periods vary by record type and applicable law. When information is no longer needed, we dispose of it securely.

11. Your Choices and Rights

Communication preferences

  • Text messages — reply STOP to any message, or contact us.
  • Email — use the unsubscribe link in any marketing email, or contact us. We will still send transactional messages about your policies, claims, and billing.
  • Mail and phone — contact us and we will update your preferences.

Access and correction

You may ask us to confirm what information we hold about you and to correct anything inaccurate. Contact us using Section 15 and we will respond promptly.

State privacy rights

Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, to opt out of targeted advertising, the sale of personal information, or certain profiling, and to appeal a denied request. We do not sell personal information or use it for targeted advertising or profiling.

Many state privacy laws exempt financial institutions, insurance licensees, or information governed by the Gramm-Leach-Bliley Act or HIPAA. Where an exemption applies, some rights may not extend to your insurance-related information. Regardless, we will acknowledge every request, tell you what we can and cannot do, and honor all requests to the extent required by law.

To exercise a right, contact us using the information in Section 15 and tell us what you are asking for. We may need to verify your identity before responding. An authorized agent may submit a request on your behalf with written authorization. We will not discriminate against you for exercising any privacy right. If we deny your request, you may appeal by replying to our response.

12. Children's Privacy

Our website and services are not directed to children. We do not knowingly collect personal information online from children under 13, and we do not sell or share the personal information of anyone under 16. If you believe a child has provided information to us through our website, contact us and we will delete it. Note that we may receive information about minor children as insureds, drivers, or benefits dependents in the ordinary course of servicing a policy, which is provided by the parent, guardian, or policyholder.

13. Third-Party Websites

Our site links to third-party sites and tools, including carrier portals, our payment portal, and our client login. Those sites have their own privacy policies, and we are not responsible for their content or practices. We encourage you to review them.

14. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the "Last Updated" date above, and we will provide additional notice for material changes. Please review this Policy periodically.
